Fan Support, Payments & Refund Terms

These Fan Support, Payments & Refund Terms explain how fan support, payments, purchases, campaign contributions, perks, rewards, product drops, digital items, refunds, cancellations, and payment disputes work on FanSpark.

These Terms apply when you use FanSpark to support a creator, participate in a campaign, purchase a product, claim a perk, receive a reward, join a paid experience, buy or claim a digital collectible, subscribe to a creator feature, or make any other payment through FanSpark.

These Terms supplement FanSpark’s Terms of Use, Privacy Policy, Creator Agreement, Campaign & Content Guidelines, Digital Collectibles Terms, DMCA/IP Policy, and any campaign-specific terms shown at checkout or on a campaign page. If these Terms conflict with the general Terms of Use on a fan support, payment, or refund issue, these Terms will control for that issue.

1. About FanSpark Fan Support

FanSpark allows fans to discover, follow, support, and participate in creator-led projects, campaigns, launches, product drops, digital collectible releases, and fan experiences.

Depending on the feature, fans may be able to:

  • Support a creator or campaign
  • Purchase a product
  • Claim a perk or reward
  • Join a waitlist
  • Participate in a launch
  • Purchase access to a creator experience
  • Subscribe to a creator feature
  • Claim or purchase a digital collectible
  • Receive digital or physical rewards
  • Participate in community voting, feedback, or fan engagement features

FanSpark provides the platform and tools that make these experiences possible. Unless FanSpark expressly states otherwise, creators are responsible for their own campaign promises, project updates, product descriptions, perks, rewards, fulfillment, delivery timelines, and fan communications.

2. Important Fan Support Disclaimer

Fan support is not an investment.

When you support a creator, contribute to a campaign, purchase a perk, claim a reward, or acquire a digital collectible through FanSpark, you are not buying equity, securities, revenue rights, profit-sharing rights, ownership rights, or any financial interest in FanSpark, the creator, or the creator’s project.

You should not support a creator or campaign with the expectation of financial return, resale profit, appreciation, dividends, revenue share, or guaranteed future value.

FanSpark is designed for fandom, creative participation, campaign support, creator engagement, product drops, perks, rewards, and entertainment experiences. It is not an investment platform.

3. Types of Fan Payments

FanSpark may support different types of payments, including:

  • One-time creator support
  • Campaign support payments
  • Product purchases
  • Pre-orders
  • Perk purchases
  • Reward claims that include payment
  • Digital product purchases
  • Digital collectible purchases
  • Shipping fees
  • Taxes and duties
  • Creator subscriptions or memberships
  • Paid access to creator experiences
  • Platform fees, service fees, or processing fees
  • Other paid FanSpark features

The specific payment type, price, included benefits, refund rules, delivery expectations, and creator obligations may vary by campaign, creator, feature, or checkout page.

You should carefully review the campaign page, product page, perk description, checkout page, and applicable terms before making a payment.

4. Role of FanSpark and Creators

FanSpark may act in different roles depending on the feature, payment flow, legal structure, and third-party payment setup. FanSpark may act as a platform provider, marketplace operator, payment facilitator, merchant of record, limited payment collection agent, software provider, or another role depending on the transaction.

Unless FanSpark expressly states otherwise:

  • Creators are responsible for their creator pages, campaigns, products, perks, rewards, promises, fulfillment, and communications.
  • FanSpark does not guarantee that a creator will complete a project, fulfill a reward, deliver a product, or meet a timeline.
  • FanSpark does not guarantee that fan support will result in any specific creative outcome.
  • FanSpark does not endorse or verify every creator claim.
  • FanSpark may help facilitate payments, communication, refunds, disputes, and platform remedies, but FanSpark is not automatically responsible for creator failures.

FanSpark may take action if a creator violates FanSpark policies, misleads fans, fails to fulfill obligations, creates risk, or receives significant complaints.

5. Payment Authorization

By submitting a payment through FanSpark, you authorize FanSpark and its payment processors to charge your selected payment method for the amount shown at checkout, including applicable taxes, shipping, service fees, platform fees, processing fees, and other disclosed charges.

You represent that:

  • You are authorized to use the payment method.
  • The payment information you provide is accurate.
  • You are legally permitted to make the payment.
  • You will not use FanSpark for fraudulent, unauthorized, illegal, or abusive transactions.

If your payment method fails, is declined, is reversed, or is charged back, FanSpark may cancel the transaction, restrict your access to related perks or items, suspend account features, request another payment method, or take other appropriate action.

6. Payment Processors

Payments on FanSpark may be processed by third-party payment processors. Your payment may be subject to the payment processor’s terms, privacy policy, fraud checks, identity verification, payment rules, and dispute procedures.

FanSpark generally does not store full credit card numbers or complete payment credentials. Those details are usually collected and processed directly by payment processors.

FanSpark is not responsible for payment processor delays, declines, outages, account holds, compliance reviews, or errors, except where required by law.

7. Prices, Fees, and Taxes

Prices are shown at checkout before you complete payment. Prices may include or exclude taxes, shipping, duties, service fees, platform fees, processing fees, and other charges depending on the transaction.

You are responsible for reviewing the total amount before submitting payment.

FanSpark may charge or collect:

  • Product prices
  • Campaign support amounts
  • Perk prices
  • Subscription fees
  • Shipping fees
  • Service fees
  • Platform fees
  • Processing fees
  • Sales tax
  • VAT, GST, or similar taxes
  • Customs duties or import fees
  • Other charges disclosed at checkout

Prices, fees, taxes, and availability may change at any time before checkout is completed.

8. Currency and Conversion

FanSpark may display prices in one or more currencies. Currency availability may depend on your location, payment method, creator location, payment processor, or platform settings.

If your payment method uses a different currency, your bank or payment provider may charge conversion fees or use exchange rates that differ from rates shown on FanSpark.

FanSpark is not responsible for third-party currency conversion fees, bank fees, foreign transaction fees, or exchange-rate differences.

9. Campaign Support

Campaign support allows fans to help creators pursue creative projects, product drops, IP launches, entertainment concepts, public domain adaptations, digital releases, or other creator-led initiatives.

Campaign support may include access to updates, perks, rewards, digital items, community features, acknowledgments, or other benefits described on the campaign page.

Unless expressly stated otherwise:

  • Campaign support does not guarantee project completion.
  • Campaign timelines are estimates.
  • Creative projects may change.
  • Perks and rewards may be delayed, modified, substituted, or canceled.
  • Campaign support does not create ownership rights.
  • FanSpark is not responsible for a creator’s failure to complete a project or fulfill rewards.
  • Refund eligibility depends on the campaign terms, these Terms, FanSpark’s policies, creator obligations, and applicable law.

Creators are expected to communicate material changes, delays, cancellations, and fulfillment issues.

10. Perks and Rewards

Creators may offer perks or rewards in connection with fan support, campaigns, purchases, product drops, or digital experiences.

Perks and rewards may include:

  • Digital downloads
  • Early access
  • Behind-the-scenes updates
  • Community access
  • Acknowledgments
  • Physical merchandise
  • Limited-edition items
  • Digital collectibles
  • Fan badges
  • Shipping-based rewards
  • Event access
  • Other creator-defined benefits

Perks and rewards are subject to availability, creator fulfillment, campaign terms, geographic limitations, platform restrictions, and applicable law.

FanSpark may allow creators to substitute a perk or reward with something of equal or greater value if the original item becomes unavailable, delayed, restricted, unsafe, legally problematic, or impossible to fulfill. Material substitutions should be communicated to affected fans.

11. Product Purchases and Product Drops

FanSpark may allow creators or FanSpark to offer products, merchandise, limited drops, pre-orders, bundles, or other items.

Product descriptions, images, availability, shipping timelines, sizing, materials, compatibility, and other details should be reviewed carefully before purchase.

Unless FanSpark expressly states otherwise, the creator or seller of the product is responsible for product accuracy, inventory, fulfillment, shipping, returns, warranties, and customer support.

FanSpark may remove or cancel product listings that violate platform policies, create risk, appear fraudulent, infringe rights, or are no longer available.

12. Shipping and Delivery

Physical products, perks, and rewards may require shipping.

Shipping timelines are estimates unless expressly guaranteed. Shipping may be affected by creator production timelines, inventory, carrier delays, customs, incorrect addresses, weather, supply chain issues, or other events outside FanSpark’s control.

You are responsible for providing a complete and accurate shipping address. FanSpark or the creator may not be responsible for failed delivery caused by incorrect or incomplete information.

You may be responsible for shipping fees, customs duties, import taxes, carrier fees, or other delivery-related charges unless the campaign or checkout page states otherwise.

For physical merchandise ordered online, sellers may have legal obligations when advertised shipping timelines are not met. FanSpark may require creators or sellers to provide updates, obtain consent to delays, issue refunds, or take other action when required by law or platform policy.

13. Digital Products and Access

Digital products, downloads, access passes, content unlocks, badges, digital perks, and similar items may become available immediately or after a campaign milestone, creator update, payment confirmation, or release date.

Unless required by law or stated otherwise, digital products and access-based purchases may become non-refundable once delivered, downloaded, accessed, claimed, unlocked, or used.

FanSpark may restrict, revoke, or modify access to digital products or features if required for legal, safety, fraud, platform, or policy reasons.

14. Digital Collectibles

FanSpark may allow fans to claim, purchase, receive, or mint digital collectibles.

Unless expressly stated otherwise:

  • Digital collectibles are for fandom, identity, access, participation, entertainment, or display.
  • Digital collectibles are not investments.
  • Digital collectibles do not guarantee future value, resale value, rarity value, profit, revenue, or ongoing utility.
  • Owning a digital collectible does not give you ownership of the underlying creator IP, artwork, characters, story world, trademarks, or commercial rights.
  • Digital collectible benefits may change, expire, or be discontinued.
  • Blockchain transactions may be irreversible.
  • FanSpark may not be able to cancel, reverse, delete, or modify blockchain transactions once completed.

Refunds for digital collectibles may be limited or unavailable after delivery, claim, minting, transfer, or use, except where required by law or expressly stated by FanSpark.

Additional rules may apply under FanSpark’s Digital Collectibles Terms.

15. Subscriptions and Recurring Payments

FanSpark may offer subscriptions, memberships, recurring creator support, paid communities, or other recurring payment features.

If you enroll in a recurring payment feature, you authorize FanSpark and its payment processors to charge your payment method on a recurring basis until you cancel or the subscription ends.

The subscription page or checkout flow should identify:

  • The subscription price
  • Billing frequency
  • Renewal terms
  • Included benefits
  • How to cancel
  • Any free trial or promotional period
  • When charges begin
  • Whether taxes or fees apply

You are responsible for canceling before the renewal date if you do not want to be charged again.

Unless FanSpark states otherwise or applicable law requires otherwise:

  • Subscription charges are non-refundable after the billing period begins.
  • Canceling stops future billing but does not automatically refund the current billing period.
  • Access may continue until the end of the paid period, unless the subscription is terminated for policy violations, fraud, chargebacks, or legal reasons.

FanSpark may change subscription features, pricing, or availability with notice where required.

16. Promotions, Discounts, and Credits

FanSpark or creators may offer promotions, discounts, credits, coupons, free trials, early access offers, or limited-time pricing.

Promotions may be subject to additional terms, eligibility requirements, expiration dates, usage limits, geographic restrictions, and availability.

Promotions have no cash value unless FanSpark states otherwise. FanSpark may modify, suspend, or cancel promotions at any time, subject to applicable law.

Credits issued by FanSpark may be limited to FanSpark use, may expire, may be non-transferable, and may not be redeemable for cash unless required by law.

17. General Refund Policy

Refund eligibility depends on the type of transaction, campaign terms, product status, fulfillment status, digital delivery status, creator obligations, payment processor rules, and applicable law.

Unless FanSpark, the creator, the campaign page, or applicable law states otherwise, payments may be non-refundable once completed, especially when:

  • Fan support has been processed
  • A campaign has received the support
  • A digital item has been delivered
  • A digital collectible has been claimed, minted, transferred, or used
  • A product has shipped
  • A perk has been fulfilled
  • Access has been granted
  • A subscription billing period has started
  • A limited-availability item has been reserved
  • A creator has begun fulfillment or production based on the payment

However, FanSpark may approve refunds, credits, cancellations, or other remedies when appropriate.

18. Refunds That May Be Approved

FanSpark may approve a refund, partial refund, credit, cancellation, or other remedy in situations such as:

  • Duplicate charges
  • Unauthorized transactions, subject to investigation
  • Technical errors
  • Payment processing errors
  • Incorrect amount charged
  • Product or perk unavailable before fulfillment
  • Campaign canceled before funds are released or used
  • Creator unable or unwilling to fulfill material campaign obligations
  • Product materially misdescribed
  • Product damaged, defective, or missing, where the seller is responsible
  • Shipping delay where a refund is required by law or platform policy
  • FanSpark determines that a refund is appropriate to protect users or the platform
  • Applicable law requires a refund

FanSpark may require documentation, investigation, creator input, return of goods, cancellation of access, revocation of perks, or other steps before approving a refund.

19. Refunds That May Be Denied

Refunds may be denied in situations such as:

  • Buyer’s remorse
  • Change of mind
  • Failure to read the campaign, product, perk, or checkout details
  • Disagreement with creative direction after support
  • Expected but non-guaranteed project outcome
  • Delays disclosed by the creator or allowed under the campaign terms
  • Digital product already accessed or downloaded
  • Digital collectible already claimed, minted, transferred, or used
  • Physical product already shipped or delivered, unless return rights apply
  • Subscription period already started
  • Violation of FanSpark policies
  • Fraud, abuse, or suspicious activity
  • Excessive refund requests
  • Chargeback abuse
  • Requests outside the stated refund window
  • Circumstances outside FanSpark’s or the creator’s reasonable control

This does not limit any non-waivable rights you may have under applicable law.

20. Campaign-Specific Refund Rules

Creators may set campaign-specific refund rules if FanSpark allows them to do so. Campaign-specific refund rules must be consistent with FanSpark policies and applicable law.

Campaign pages may identify:

  • Whether support is refundable
  • Refund request deadlines
  • Milestone-based refund rules
  • Conditions for campaign cancellation
  • How refunds are handled if a project changes
  • Whether perks are refundable
  • Whether shipping fees are refundable
  • Whether digital rewards are refundable
  • Whether collectible claims are refundable

If no campaign-specific refund rule is posted, FanSpark’s general refund rules apply.

21. Product Return Policy

If FanSpark or a creator offers returns for physical products, the product page or return instructions may specify:

  • Return window
  • Product condition requirements
  • Packaging requirements
  • Return shipping responsibility
  • Refund method
  • Restocking fees, if allowed
  • Non-returnable items
  • Damaged or defective item procedures
  • Exchange availability

Unless stated otherwise, physical products may need to be returned unused, undamaged, and in their original condition before a refund is issued.

Certain items may be final sale, including customized items, made-to-order items, limited drops, digital items, opened media, hygiene-sensitive goods, or items marked final sale, except where required by law.

22. How to Request a Refund

Your refund request should include:

  • Account email
  • Transaction date
  • Creator or campaign name
  • Product, perk, reward, or collectible name
  • Order number or transaction ID, if available
  • Reason for the request
  • Supporting documentation, if relevant

FanSpark may ask for additional information to review your request.

Submitting a refund request does not guarantee approval.

23. Refund Method and Timing

Approved refunds are generally issued to the original payment method unless FanSpark determines another method is appropriate or required.

Refund timing may depend on the payment processor, bank, card network, wallet provider, or other third party.

FanSpark is not responsible for delays caused by banks, card issuers, payment processors, wallet providers, or other third-party systems.

Service fees, processing fees, shipping fees, taxes, duties, and platform fees may be non-refundable unless FanSpark determines otherwise or applicable law requires otherwise.

24. Cancellations

FanSpark may allow cancellations before a product ships, a digital item is delivered, a collectible is claimed or minted, a campaign milestone is reached, or a creator begins fulfillment.

Cancellation availability may vary by transaction type.

FanSpark, creators, or sellers may cancel transactions for reasons such as:

  • Payment failure
  • Fraud risk
  • Policy violations
  • Pricing or listing errors
  • Inventory issues
  • Rights issues
  • Legal restrictions
  • Shipping restrictions
  • Creator cancellation
  • Platform risk
  • Technical errors

If FanSpark or a creator cancels a transaction after payment, FanSpark may issue a refund, credit, or other remedy as appropriate.

25. Failed, Reversed, or Disputed Payments

If a payment fails, is reversed, is disputed, or is subject to chargeback, FanSpark may:

  • Cancel the transaction
  • Revoke access to related features, perks, rewards, or collectibles
  • Restrict account access
  • Suspend support or purchase privileges
  • Delay or cancel fulfillment
  • Require an alternate payment method
  • Offset amounts from related credits or balances
  • Cooperate with payment processors, banks, and card networks

You agree not to file false, abusive, or bad-faith disputes or chargebacks.

Nothing in these Terms limits any lawful billing dispute or chargeback rights you may have under applicable law.

26. Fraud, Abuse, and Platform Protection

FanSpark may delay, hold, cancel, refund, reverse, restrict, or investigate transactions if we believe there is risk of:

  • Fraud
  • Unauthorized payment
  • Payment method misuse
  • Chargeback abuse
  • Money laundering
  • Sanctions violations
  • Bot activity
  • Account compromise
  • Market manipulation
  • Fake support activity
  • Artificial campaign inflation
  • Suspicious creator or fan behavior
  • Policy violations
  • Legal or compliance issues

FanSpark may use automated tools, manual review, payment processor checks, identity verification, risk scoring, and other methods to protect the platform.

27. Geographic Restrictions

Some FanSpark features, payments, campaigns, products, collectibles, shipping options, or rewards may not be available in all locations.

Availability may depend on laws, payment processor rules, sanctions restrictions, shipping limitations, creator settings, tax requirements, platform policy, or technical constraints.

FanSpark may block, limit, cancel, or refund transactions that cannot legally or practically be completed in a particular location.

28. Minors

You must be at least 13 years old to use FanSpark.

If you are under the age of majority where you live, you may make payments through FanSpark only with permission and supervision from a parent or legal guardian.

FanSpark may cancel or refund transactions involving minors if required by law, requested by a parent or guardian, or necessary to protect users or the platform.

29. Taxes and Reporting

You are responsible for any taxes, duties, or government charges that apply to your purchases, support payments, product orders, rewards, subscriptions, collectibles, or other FanSpark transactions.

FanSpark may calculate, collect, report, or remit taxes where required or where FanSpark chooses to do so.

Tax treatment may vary depending on your location, the creator’s location, transaction type, and applicable law.

30. Creator Failure or Campaign Issues

If a creator fails to communicate, delays fulfillment, cancels a project, misrepresents a campaign, or fails to deliver promised perks or products, FanSpark may take action, including:

  • Requesting a creator update
  • Requiring a fulfillment plan
  • Restricting the campaign
  • Pausing creator payouts
  • Issuing refunds or credits
  • Removing creator content
  • Suspending creator access
  • Referring the issue to payment processors or legal authorities
  • Taking other platform-protection measures

FanSpark does not guarantee that funds will always be recoverable from a creator.

FanSpark may not be able to provide refunds if funds have already been released to a creator, spent on campaign work, or become unrecoverable, unless required by law or FanSpark determines otherwise.

31. Changes to Payments, Refunds, and Features

FanSpark may change payment methods, fees, refund procedures, subscription features, campaign tools, product drop rules, collectible claim flows, or other payment-related features at any time.

Changes will apply going forward unless FanSpark states otherwise or applicable law requires otherwise.

32. Conflict With Campaign Terms

A campaign, product page, checkout page, or creator offering may include specific terms. Those specific terms apply to the relevant transaction as long as they do not conflict with FanSpark’s mandatory policies or applicable law.

If a creator posts terms that conflict with FanSpark’s policies, FanSpark’s policies control.
